1. Terms and Conditions of Competition

The following terms and conditions apply to the GRID CONNECT DL101HA competition (Competition Terms).

2. Key Information

The following is a summary of the key information contained in, and is subject to, the following terms and conditions:

(a) How to enter: Visit https://grid-connect.com.au/a1d4pii8tbox5op4c9l6/ 

(b) Who can enter: Australian residents (only), aged 18 years and over who have a Grid Connect account with at least one Grid Connect device bound to it at the time of judging and are a subscriber to Grid Connect Sneak Peaks at the time of judging. 

(c) Competition: Skill based competition – Most original literary and creative response to the question:

How would you use a smart padlock?

(d) Competition Period:

(i) Starts: 12:00 p.m. (AEST) 11 March 2022.

(ii) Ends: 11:59 p.m. (AEDT) 15 April 2022.

(e) Prizes:

(i) Number: 10 prize winners.

(ii) Prize: Grid Connect Smart Padlock valued at $49 AUD at time of writing.

(f) Judging:

(i) Location: 36 Lakeview Drive, Scoresby VIC 3179

(ii) Time & Date: Within 7 days of the competition period having concluded.

3. How to Enter

To enter the GRID CONNECT DL101HA competition each Entrant must, during the Competition Period referred to in 2 (d) above:

(a) Go to https://grid-connect.com.au/a1d4pii8tbox5op4c9l6/ and submit the required fields on the GRID CONNECT DL101HA competition page including

(i) Agree that these Competition Terms apply to the Entrant.

(ii) Provide the Entrant’s name and email address.

(iii) Be a current subscriber to Grid Connect Sneak Peaks, or subscribe at the time of entry. An Entrant must be a subscriber at the time of judging for the Entry to be valid. 

By entering into the GRID CONNECT DL101HA competition in the above manner, each Entrant agrees that these Competition Terms apply to them.

4. Who can Enter

(a) Only natural persons who are residents of Australia, aged 18 years and over and with a permanent address in Australia may enter the GRID CONNECT DL101HA competition.

(b) Persons who are employees of the Promoter, who are employees of suppliers or contractors to, or entities or persons otherwise engaged by, the Promoter or are Relatives of any such employees, entities or persons are not eligible to win the GRID CONNECT DL101HA competition.

(c) Any dispute about whether or not a person is eligible to win the GRID CONNECT DL101HA competition will be determined by the Promoter.

(d) Only persons who have a Grid Connect account in the Grid Connect app as downloaded from the Google Play or Apple App stores with at least one Grid Connect device bound to it at the time of judging will be considered valid entrants alongside any other requirement stipulated throughout these terms and conditions. The device may be one which has been bound to another account and then provided shared access from another user but it must appear in the entrants listed account’s device list when they log-in to the Grid Connect app at the time of judging.

(e) Only persons who are subscribes of Grid Connect Sneak Peaks at the time of judging will be considered valid entrants alongside any other requirement stipulated throughout these terms and conditions. The Entrant can subscribe as part of the Entry form found at 2(a). 

5. Determination of Winners

(a) There will be 10 prize winners selected during judging.

(b) At the location and within the time period and dates referred to in 2 (f) above, a panel of judges determined by the Promoter will determine from the entries that have been provided by the time in 2(d) (ii) above the Entry to be the most original literary and creative response to the question ‘How would you use a smart padlock?’ The answers to any questions included as part of the entry or the completion or lack there of any non-required fields will not impact the validity of the entry provided the entry is deemed valid based on all aspects of these terms and conditions.

(c) The promoters representatives’ determination in accordance with 5 (b) is final and no correspondence will be entered into.

(d) Each Entrant who is selected in accordance with 5 (b) is a “Winner”.

6. Prizes

(a) Each Winner will receive the prize as defined in 2(e)(ii) or a similar prize of equal or greater value as determined by the Promoter (Prize).

(b) The Winner will be responsible for all charges associated with the usage of a Prize and any taxes (other than GST) which may be payable as a result winning a Prize.

(c) A Prize is not transferable, exchangeable or redeemable for cash. If a Winner chooses not to accept or receive the Prize, the Prize is deemed to be forfeited and the Promotor is not obliged to substitute the Prize nor are they required to complete a re-draw, however they may at their discretion choose to do so.

(d) The first name and all or part of the winning Entry of each Winner may be published by the Promoter on the Promoter’s webpage or in other places alongside the Grid Connect branding unless the Entrant specified at 3 (a) (iv) that they did not want their Entry used for marketing purposes. If the Entrant nominated an alternate name to be used or the name not to be published on the initial entry then that will be adhered to by the promoter. 

(e) The Promoter will contact each Winner by the email address the Winner provides when entering the GRID CONNECT DL101HA competition to advise that they have been determined to be a Winner and have won a Prize and obtain from them their preferred address for delivery of the Prize. Should the Winner not return contact within 30 days of receiving notification of their Win then they forfeit their claim to a Prize, unless extenuating reasons as determined by the Promoter have been established. The Promoter may choose to honour the Prize claim at their discretion but is not bound by these Terms and Conditions to do so regardless of the circumstances surrounding the delayed Prize claim.

(f) Delivery of Prizes to Winners will be made after they have been contacted by the Promoter and advised that they have been determined to be a Winner and have won a Prize and have provided their address for delivery of the Prize.

7. Delivery

(a) The Promoter will organise and pay the costs of delivery of Prizes to Winners.

(b) Prizes will be sent to Winners at the address provided by a Winner for delivery by Registered Post using Australia Post.

(c) The Promoter will not be responsible for any loss or damage to Prizes once they have been delivered as provided for in 7 (b).

(d) The Promoter does not deliver Prizes outside of Australia.

8. Publication of Winner/Entrants

(a) The first name and all or part of the winning response of each Winner may be published by the Promoter on the Promoter’s webpage or in other places alongside the Grid Connect branding unless the Entrant specified at 3 (a) (iv) that they did not want their Entry used for marketing purposes. If the Entrant nominated an alternate name to be used or the name not to be published on the initial entry then that will be adhered to by the promoter for marketing purposes. Stated first names, surname initial and residential state provided will be published in the winners list on the Grid Connect website. 

(b) The first name and all or part of the winning response of any Entrant may be published by the Promoter on the Promoter’s webpage or in other places alongside the Grid Connect branding unless the Entrant specified at 3 (a) (iv) that they did not want their Entry used for marketing purposes. If the Entrant nominated an alternate name to be used or the name not to be published on the initial entry then that will be adhered to by the promoter. 

(c) The Promoter reserves the right to adjust the Entry contents for clarity, space constraints or other purposes without consultation with the Entrant/Winner.

9. Personal Information

(a) Other than as provided in 8 above and 10 below, none of the other personal information of an Entrant will be published on the Promoter’s webpage, or other promotional materials of the Promoter. This includes the email address provided for correspondence and the Grid Connect account user name.

(b) The Promotor uses various technologies (including cookies (generally), analytic cookies, targeting, advertising and remarketing cookies, web beacons and pixels, and other types of technologies) which assist the Promotor in its functions and activities including dealings with you and for marketing and remarketing purposes.

(c) The personal details of Entrants will otherwise be held, used and disclosed in accordance with the Privacy Policy of the Promoter and the provisions of these Competition Terms. The Privacy Policy of the Promoter appears on the www.grid-connect.com.au website.

(d) By an Entrant entering the GRID CONNECT DL101HA competition the Entrant acknowledges, agrees and consents to the Promoter’s use of the personal information of the Entrant in the manner set out above in 8, in this 9 and below in 10.

(e) By an Entrant entering the GRID CONNECT DL101HA competition the Entrant acknowledges, agrees and consents to the Promoter verifying their eligibility in regards to 4(d) during the judging process.

10. Entries

(a) Each Entry must be accompanied by a valid email address of the Entrant and a valid Grid Connect account (email or mobile).

(b) An email address may only be used for one Entry throughout the competition period outlined in 2(d) above.

(c) The Promoter accepts no responsibility for Entries that are not received for any reason during the Competition Period in (2) (d) above.

(d) The Promoter reserves the right to determine whether an Entrant and/or an Entry complies with the requirements of the GRID CONNECT DL101HA competition as provided for in these Competition Terms including but not limited to the account and device requirement described in 4(d).

11. Force Majeure

If for any reason the  GRID CONNECT DL101HA competition is not capable of being run as planned in accordance with these Competition Terms (including, without limitation, due to technical failures, computer viruses, bugs, tampering, unauthorised intervention, fraud, office closures relating to COVID-19 exposure or any other cause beyond the reasonable control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the GRID CONNECT DL101HA competition), the Promoter reserves the right in its sole discretion to disqualify any Entrant who may be involved in such things and to cancel, terminate, modify or suspend the GRID CONNECT DL101HA competition.

12. Miscellaneous

Things to be determined by the Promoter in accordance with these Competition Terms, will be determined by the Promoter in its absolute discretion, and once so determined by the Promoter are final and no correspondence will be entered into in relation to same.

Nothing in these Competition Terms shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy provided by law (including, without limitation, the Australian Consumer Law) and which by law cannot be excluded, restricted or modified.

These Competition Terms are subject to variation by the Promoter from time to time by the Promoter amending these Competition Terms as they appear on Grid Connect website.

Headings used in these Competition Terms are for convenience only and shall be ignored in construing these Competition Terms.

Entrant means each person who enters into the GRID CONNECT DL101HA competition in accordance with these Competition Terms.

GST has the meaning ascribed to that term by A New Tax System (Goods and Service Tax) Act 1999 (Cth).

Promoter means Arlec Australia Pty. Ltd. ACN 009 322 105.

Relative has the meaning ascribed to that term by the Corporations Act 2001 (Cth).

Grid Connect website means the website at www.grid-connect.com.au.

Any provision of these Competition Terms which is or becomes prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective and severed to the extent thereof without invalidating any other provision of these Competition Terms, and any such prohibition or unenforceability shall not invalidate such provision in any other jurisdiction.

These Competition Terms and any contract entered into between the Promoter and an Entrant as a result of an Entrant entering into GRID CONNECT DL101HA competition in accordance with these Competition Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia and each Entrant submits to the non-exclusive jurisdiction of the Courts of the State of Victoria, Australia and of any Courts which may hear appeals therefrom.
