 1. Terms and Conditions of Competition

The following terms and conditions apply to the GRID CONNECT Kit Competition (Competition Terms).

2. Key Information

The following is a summary of the key information contained in, and is subject to, the following terms and conditions:

(a) How to enter: Visit  https://grid-connect.com.au/avfinoti4h3hmjw6vy73/

(b) Who can enter: Australian residents (only), aged 18 years and over, who have purchased from a Bunnings store, and own, 3 Mill Eligible Heaters.

(c) Competition: Most original and creative self-recorded video response to the question:

What excites me the most about having smart home control of my Mill Heater using the Grid Connect App?

The video response must be self-recorded, be of not less than and not more than 30 – 45 seconds in length and not include any person other than the self-recording Entrant.

(d) Competition Period:

(i) Starts: 12:00 a.m. (Melbourne time), 05 May 2022

(ii) Ends: 11:59 p.m. (Melbourne time), 30 June 2022

(e) Prizes:

(i) Number: 20 prize winners.

(ii) Prize: “Grid Connect Kit” valued at $353.70. The Grid Connect Kit comprises: 3 x Arlec Grid Connect Smart Single Adaptor with Temperature and Humidity Sensors and Power Meter ($34.90 RRP AUD each); and 1 x Samsung Galaxy Tab A7 Lite Wi-Fi 32GB ($249 RRP AUD).

(f) Judging

(i) Location: 36 Lakeview Drive, Scoresby, Victoria 3179.

(ii) Time & Date: Between 11:59 p.m. (Melbourne time), 30 June 2022 and 11:00 a.m. (Melbourne time) 08 July 2022

3. How to Enter

To enter the GRID CONNECT Kit Competition, each Entrant must during the Competition Period referred to in 2 (d) above:

(a) Go to the https://grid-connect.com.au/avfinoti4h3hmjw6vy73 link for the GRID CONNECT Kit Competition

(b) Following the prompts for the link to the GRID CONNECT Kit Competition page:

(i) Agree that these Competition Terms apply to the Entrant.

(ii) Provide the Entrant’s full name, email address and State or Territory of residence.

(iii) Upload:

i           proofs of purchase for at least 3 Mill Eligible Heaters from a Bunnings store; and

ii           one original and creative self-recorded video response to the question:

What excites me the most about having smart home control of my Mill Heater using the Grid Connect App?

(Video Response).The Video Response must be self-recorded, be of not less than and not more than 30 – 45 seconds in length and not include any person other than the self-recording Entrant.

This is an Entry.

By entering into the GRID CONNECT Kit Competition in the above manner, each Entrant agrees that these Competition Terms apply to them.

4. Who can Enter

(a) Only natural persons who are residents of Australia, aged 18 years and over, with a permanent address in Australia and have purchased from a Bunnings store and own 3 or more Mill Eligible Heaters may enter the GRID CONNECT Kit Competition.

(b) Persons who are employees of the Promoter, who are employees of suppliers or contractors to, or entities or persons otherwise engaged by, the Promoter or are Relatives of any such employees, entities or persons are not eligible to win the GRID CONNECT Kit Competition.

(c) Any dispute about whether or not a person is eligible to win the GRID CONNECT Kit Competition will be determined by the Promoter.

5. Determination of Winners

(a) There will be 20 prize winners.

(b) At the location and within the time period and dates referred to in 2 (f) above, a panel of judges determined by the Promoter will determine from the Entries that have been provided by the time in 2 (d) (ii) above the 20 Entries to be the most original and creative self-recorded video responses to the question:

What excites me the most about having smart home control of my Mill Heater using the Grid Connect App?

(c) The judges’ determination in accordance with 5 (b) is final and no correspondence will be entered into.

(d) Each Entrant who is determined to have submitted one of the 20 most original and creative self-recorded video responses in accordance with 5 (b) is a “Winner”.

(e) Chance plays no part in the determination of a Winner.

6. Prizes

(a) Each Winner will receive a Grid Connect Kit (valued at $353.70, including GST) or a similar prize of equal or greater value as determined by the Promoter (Prize).

(b) A Grid Connect Kit comprises:

(i) 3 x Arlec Grid Connect Smart Single Adaptor with Temperature and Humidity Sensors and Power Meter ($34.90 RRP AUD each); and

(ii) 1 x Samsung Galaxy Tab A7 Lite Wi-Fi 32GB ($249 RRP AUD)

(c) A similar prize of equal or greater value than the Prize may be provided if circumstances beyond the reasonable control of the Promoter prevent the specified Prize from being able to be delivered to a Winner.

(d) The Winner will be responsible for all charges associated with the usage of a Prize and any taxes (other than GST) which may be payable as a result winning a Prize.

(e) A Prize is not transferable, exchangeable, or redeemable for cash. Prizes will be preserved for a period of 3 months. If a Winner chooses not to accept or receive the Prize after that period, the Prize is deemed to be forfeited and the Promoter is not obliged to substitute the Prize.

(f) The Name and State or Territory of residence of each Winner will be published by the Promoter on the Grid Connect website.

(g) The Promoter will also contact each Winner in writing at the email address the Winner provides when entering the GRID CONNECT Kit Competition to advise that they have been determined to be a Winner and have won a Prize and obtain from them their address for delivery of the Prize.

(h) Delivery of Prizes to Winners will be made after they have been contacted by the Promoter and have provided their address for delivery of the Prizes. Entrants with multiple Entries may win more than one Prize.

7. Delivery

(a) The Promoter will organise and pay the costs of delivery of Prizes to Winners.

(b) Prizes will be sent to Winners at the address provided by a Winner for delivery by Registered Post using Australia Post.

(c) The Promoter will not be responsible for any loss or damage to Prizes once they have been delivered as provided for in 7 (b).

(d) The Promoter does not deliver Prizes outside of Australia.

8. Publication of Winner/Entrants

(a) The Names (i.e. last name and initial of first name) and State or Territory of residence of each Winner (with or without the Winner’s Video Response):

(i) will be published by the Promoter on the Grid Connect website within 30 days of judging; and

(ii) may also be published on the Grid Connect Website, Grid Connect App and other social media of the Promoter and other promotional materials of the Promoter at any time.

The Names and State or Territory of residence of each Entrant (with or without the Entrant’s Video Response) who is not a Winner:

(i) may also be published by the Promoter on the Grid Connect website at any time; and

(ii) may be published on the Grid Connect App and other social media of the Promoter and other promotional materials of the Promoter at any time.

9. Personal Information

(a) Other than as provided in 8 above and 10 below, none of the other personal information of an Entrant will be published on the Grid Connect website, Grid Connect App, other social media or other promotional materials of the Promoter.

(b) The Promoter uses various technologies (including cookies (generally), analytic cookies, targeting, advertising and remarketing cookies, web beacons and pixels, and other types of technologies) which assist the Promoter in its functions and activities including dealings with Entrants and for marketing and remarketing purposes.

(c) The personal details of Entrants will otherwise be held, used and disclosed in accordance with the Privacy Policy of the Promoter and the provisions of these Competition Terms. The Privacy Policy of the Promoter appears on the Grid Connect

(d) By an Entrant entering the GRID CONNECT Kit Competition, the Entrant acknowledges, agrees and consents to the Promoter’s use of the personal information of the Entrant in the manner set out above in 8, in this 9 and below in 10.

(e) Records of Entrants will be kept for a period of 3 years (or such longer period as may be required by law) after the finalisation of the GRID CONNECT Kit Competition.

10. Entries and Video Response

(a) Each Entry must be accompanied by a valid email address of the Entrant.

(b) An email address may be used for more than one Entry, provided each entry is different (i.e. contains proof of purchase of 3 different Mill Eligible Heaters and a different Video Response).

(c) An Entrant may provide as many Entries as an Entrant determines.

(d) Each Entrant represents and warrants to the Promoter that each proof of purchase the Entrant provides:

(i) is a genuine receipt from a Bunnings store;

(ii) has not been previously used by the Entrant or provided to another person or entity for the purpose of the GRID CONNECT Kit Competition; and

(iii) represents a Mill Eligible Heater, as set out in 12 below, that was purchased from a Bunnings store and is owned by the Entrant and in their possession.

(e) Each Video Response must be self-recorded, be of not less than and not more than 30 – 45 seconds in length and not include any person other than the self-recording Entrant.

(f) Each Entrant represents and warrants to the Promoter that each Video Response the Entrant provides:

(i) is the original independent work of the Entrant;

(ii) has not previously been provided to, or published by, another person or entity;

(iii) was self-recorded and is owned by the Entrant;

(iv) does not include any person other than the Entrant; and

(v) does not infringe the intellectual property or other rights (including, without limitation, copyright, trade mark or design rights) of any third party.

(g) Each Entrant agrees that each Video Response the Entrant provides:

(i) becomes and remains the absolute property of the Promoter; and

(ii) may be published and otherwise used (with or without the Name and State or Territory of residence of the Entrant) by the Promoter on the Grid Connect website, Grid Connect App and other social media and promotional materials of the Promoter without claim by the Entrant against the Promoter or payment of compensation by the Promoter to the Entrant.

(h) Each Entrant further agrees in relation to each Video Response the Entrant provides that:

(i) the Entrant will not give its consent for any of the Moral Rights of the Entrant in the Video Response to be used by any person not authorised by the Promoter;

 (ii) the Entrant does not require the Promoter or any person authorised by the Promoter to identify the Entrant as the creator of the Video Response;

 (iii) the Entrant agrees and consents to the Promoter using, modifying, altering and otherwise changing the Video Response, including (without limitation) compiling the Video Response with video responses of other entrants; and

 (iv) the Entrant waives its Moral Rights in the Video Response.

(i) The Promoter accepts no responsibility for Entries that are not received for any reason during the Competition Period in (2) (d) above.

(j) The Promoter reserves the right to disqualify any Entry that is:

(i) incomplete or incorrect;

(ii) offensive or defamatory (determined at the sole discretion of the Promoter);

(iii) illegible or not deemed to be a satisfactory proof of purchase; and/or

(iv) in breach of any law.

(k) The Promoter reserves the right to determine whether an Entrant and/or an Entry complies with the requirements of the GRID CONNECT Kit Competition as provided for in these Competition Terms.

11. Force Majeure

If for any reason the GRID CONNECT Kit Competition is not capable of being run as planned in accordance with these Competition Terms (including, without limitation, due to technical failures, computer viruses, bugs, tampering, unauthorised intervention, fraud, or any other cause beyond the reasonable control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the GRID CONNECT Kit Competition), the Promoter reserves the right in its sole discretion to disqualify any Entrant who may be involved in such things and to cancel, terminate, modify or suspend the GRID CONNECT Kit Competition.

12. Miscellaneous

Things to be determined by the Promoter in accordance with these Competition Terms, will be determined by the Promoter in its absolute discretion, and once so determined by the Promoter are final and no correspondence will be entered into in relation to same.

Nothing in these Competition Terms shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy provided by law (including, without limitation, the Australian Consumer Law) and which by law cannot be excluded, restricted or modified.

These Competition Terms are subject to variation by the Promoter from time to time by the Promoter amending these Competition Terms as they appear on Grid Connect website.

Headings used in these Competition Terms are for convenience only and shall be ignored in construing these Competition Terms.

Entrant means each person who enters into the GRID CONNECT Kit Competition in accordance with these Competition Terms.

Grid Connect App means the Promoter’s app which can used to remotely control a Mill Eligible Heater.

Grid Connect website means the website at www.grid-connect.com.au.

GST has the meaning ascribed to that term by A New Tax System (Goods and Service Tax) Act 1999 (Cth).

Mill Eligible Heaters means any of the following heaters that have been purchased from a Bunnings store:

(i) AU IB600TIM;

(ii) AU IB900TIM;

(iii) AU MILL1500AT;

(iv) AU MILL2000AT;

(v) AU IB800LTIM; or

(vi) AU IB1000LTIM.

Any heater not listed above is not  eligible for inclusion toward the 3 x Mill Eligible Heater requirement for an Entry unless the Promoter advises otherwise. Mill Eligible Heaters do not need to have been purchased during the Competition Period, nor do they need to be on the same proof of purchase document in order to be considered a Mill Eligible Heater.

Moral Rights has the meaning ascribed to that term by the Copyright Act 1968 (Cth).

Name means the last name and the initial of the first name of the Entrant or Winner.

Relative has the meaning ascribed to that term by the Corporations Act 2001 (Cth).

social media includes Instagram, Flickr, Facebook, LinkedIn, Pinterest, Twitter, YouTube, websites, blogs, forums and other social media platforms used by the Promoter.

Any provision of these Competition Terms which is or becomes prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective and severed to the extent thereof without invalidating any other provision of these Competition Terms, and any such prohibition or unenforceability shall not invalidate such provision in any other jurisdiction.

These Competition Terms and any contract entered into between the Promoter and an Entrant as a result of an Entrant entering into the GRID CONNECT Kit Competition in accordance with these Competition Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia and each Entrant submits to the non-exclusive jurisdiction of the Courts of the State of Victoria, Australia and of any Courts which may hear appeals therefrom.
